Terms and Conditions

1. Definitions

Designated Area: means the area identified as the designated area by Saltwater;

Event means the Rhythm & Ride 2019: Rodeo Campdraft Country Music to be hosted by Saltwater;

Event Area means the area designated by Saltwater as part of the Event;

Event Organiser means the person, persons or entity engaged by Saltwater to organise the Event;

Prohibited Items include:

(a) alcohol;

(b) weapons;

(c) dangerous materials;

(d) illicit drugs or illicit substances of any kind

(e) substances that are reasonably likely to cause offence to another person or Spectator;

Saltwater means Saltwater Country Inc;

Spectator means a person who has been granted the right to attend the Event;

Term: means these terms and conditions.

Ticket means any document provided by Saltwater, which grants the Spectator the right to attend the Event;

Ticket Price means the amount a Spectator pays to Saltwater (or Saltwater’s approved agents) for the right to attend the Event.

2. Binding contract

Spectators agree to be bound by these Terms.

3. General terms and conditions

Saltwater reserves the right without notice to vary these Terms at its discretion, or to comply with any law, legislation or reasonable request made by any government or authority. Spectators agree to be bound by any subsequent alterations or changes to these Terms.

4. The Event

4.1 Event co-ordination

Saltwater may delegate any power, control, authority or decision outlined in these Terms to the Event Organiser.

4.2 Admission

Subject to these Terms, upon presenting a Ticket Saltwater will allow a person entry to the Event.
Saltwater reserves the right to refuse any person admission to the Event without providing any reason. Saltwater’s liability to a Spectator in connection with any such refusal shall cease upon refunding the Spectator their Ticket Price.

4.3 Removal from the Event

Saltwater reserves the right to eject any person from the Event without providing any reason. Any Spectator that is ejected from the Event due to a breach of these Terms will not be entitled to a refund of the Ticket Price.

4.4 Postponement and Cancellation

Saltwater reserves the right to open or close the Event early without providing any reason. Spectators will not be entitled to a refund of their Ticket Price.

Saltwater reserves the right to change the Event program, date, venue or time of the Event without notice at any time. If such a change occurs Spectator’s tickets will remain valid for the rescheduled event and the liability to the Spectator shall cease upon any refunding of the Ticket Price.

Saltwater reserves the right to cancel the Event without providing any reason. Saltwater’s liability to a Spectator in connection with any such cancellation shall cease upon refunding to the Spectator their Ticket Price.

4.5 Refunds

(a) To the extent permitted by law, refunds will be provided at Saltwater’s absolute discretion.

(b) Refunds will be made cash/to the credit card used in the original transaction.

5. Images

Saltwater and its affiliates may take photos or video recordings at the Event for their publications, websites or promotional materials and Saltwater provide copies of those photos or video recordings to third parties for commercial and promotional purposes.

Spectators consent to, and release Saltwater from any potential claims arising from, the use of photos, videos and other recordings of Spectators for the above commercial and promotional purposes.

6. Tickets

6.1 Sale of Tickets

(a) Saltwater will accept the following form of payment:

(i) credit card, debit card; and

(ii) cash

(b) Saltwater reserves the right not to sell tickets to any person, agent or company.

6.2 Refund of tickets

Except as provided in clause 4.4 Saltwater will not refund, exchange or substitute tickets after purchase. Saltwater will also not replace tickets that have been stolen, lost or destroyed.

6.3 Transfer

Tickets are transferable without notice to Saltwater and, subject to these Terms, may be presented by any person to allow entry to the Event.

7. Spectator’s Responsibility and obligations

7.1 Spectator’s conduct

During the Event Spectators must:

(a) comply with these Terms;

(b) obey the reasonable instructions of Saltwater’s representatives within the Event Area and Designated Area;

(c) behave in a quiet, orderly and respectable manner;

(d) not act in an offensive or derogatory manner (physical or verbal) to any other person or Spectator within the Event, or any peripheral area of the Event;

(e) be properly attired when attending the Event; and

(f) not bring any Prohibited Items into the Event Area.

7.2 Transportation

Spectators are responsible for their own transportation to and from the Event.

8. Service of alcohol

8.1 Prohibitions relating to the service of alcohol

The following prohibitions relate to possession, consumption and supply of alcohol:

(a) No alcohol can be brought in to the Event by Spectators from outside the Event Area;

(b) No alcohol can be taken outside of the Designated Area; and

(c) No alcohol can be supplied to any persons under the age of 18, irrespective of whether that person is accompanied by an adult.

8.2 Obligations relating to the consumption of alcohol

All alcohol must be consumed responsibly within the Designated Area.

9. Privacy

Spectator’s may be required to submit personal or confidential information about themselves (including, without limitation, their name, address, telephone number, e-mail address, (Personal Information) to Saltwater for the purposes of the Event.

10. Saltwater may collect and store this Personal Information for the purpose of coordinating the Event and for its own promotional purposes. For the purposes of the Event, Spectator’s details will be provided to the parties directly related to the Event including the Event Organiser, event sponsors, venue providers and catering companies.

11. Liability

Except for any liability that cannot by law be excluded, Saltwater, its officers, employees, agents, sponsors and representatives are not responsible for and exclude all liability (including negligence) for any personal injury, loss or damage, whether direct, indirect, special or consequential, arising in any way out of a Spectator’s attendance at the Event.

12. Governing Law

This Agreement is governed by the laws in the state of Western Australia.

13. Severability

If any of these Terms become illegal, invalid or unenforceable it will be severed and the remaining terms will not be affected.
